Leasing law in Belarus
PrintLeasing in Belarus is regulated by a number of legislative acts. Currently the following documents are actual national regulatory acts in the sphere of leasing:
- Civil Code (Article «Financial lease (leasing) (represents the basis of leasing regulation in the country and contains basic definitions);
- Regulation on leasing approved by decision N 865 of the Council of Ministers of the Republic of Belarus on June 4, 2010 (specifies the main provisions, leasing terms and the procedures of leasing operations in Belarus);
- Order of the president of the Republic of Belarus N 465 "On certain issues of improvement of leasing activities in the Republic of Belarus" (regulates the issues of international leasing, defines the rights and obligations of the Lessor).
Belarus is a signatory of a number of international conventions that regulate leasing activities. In particular, in 1999 Belarus joined UNIDROIT convention that regulates international leasing, and in 2001 Belarus signed the Convention of intergovernmental leasing.
Among legislative instruments of leasing regulation in Belarus one can also mention Decision No. 548/8 of the Council of Ministers of the Republic of Belarus that regulates the mechanism of export transactions including purchasing and re-purchasing of the objects of leasing. The accounting of leasing operations is guided by “Instruction on the order of accounting of leasing transactions” approved by the Ministry of Finance of the Republic of Belarus in 2004.
